Terms of Service

These terms are an agreement between you and LST Properties, LLC, a Kentucky limited liability company operating Louisville Wholesale Homes from 719 Executive Park, Louisville, KY 40207. By using this website or creating an account, you accept them. If you do not accept them, do not use the site.

1. Who may use the site

You must be at least 18 years old and able to enter a binding contract. You agree to give accurate information when you register and to keep it current. Accounts are for one person or one buying entity. Do not share your login.

2. Your account

You are responsible for everything that happens under your account and for keeping your password private. Tell us right away at (502) 586-2702 if you believe someone else is using it. We may suspend or close an account that violates these terms, that is used to scrape or redistribute our property data, or that is used to harass our team, our sellers or our occupants.

3. What this site is, and what it is not

We market real property that we own or that we hold under a purchase contract. When we sell you a property we are selling our own interest, usually by assigning our purchase contract to you. We are acting as a principal in the transaction, for our own account and in our own interest.

We are not your real estate broker, agent or fiduciary. We do not represent you, we do not owe you agency duties, and nothing on this site is a listing service. If you want representation, hire your own licensed agent or attorney. We are happy to work with them.

4. Property information and estimates

Property details, photographs, square footage, bed and bath counts, opinions of value, after repair values, repair estimates, rent estimates and projected spreads are provided as a courtesy. They are estimates, not promises, and no guarantees are expressed or implied. All properties are subject to errors, omissions, prior sale or withdrawal at any time.

Buyers are responsible for their own independent inspections and due diligence, including verifying condition, title, zoning, permits, occupancy, square footage and rents. Do not buy a property based on numbers from this site alone.

5. Purchase terms

Properties are sold as-is for cash or hard money, with funds verified before closing. A non refundable earnest money deposit of $5,000 is required within 24 hours of acceptance on a first purchase with us, and $2,500 thereafter, with a 21 day or less closing period unless otherwise agreed in writing. A property is not under contract until a signed contract and earnest money are received. The signed purchase or assignment agreement controls in every case, and these terms do not modify it.

6. No professional advice

Nothing on this site is legal, tax, accounting, appraisal, engineering or investment advice. Real estate investing carries risk, including the risk of loss. Consult your own professionals before you commit money.

7. Acceptable use

• Do not scrape, crawl, bulk download or resell data from this site.
• Do not republish our property photos, addresses or deal numbers on another marketing channel without our written permission.
• Do not contact our sellers or occupants directly to go around us.
• Do not attempt to break, probe or overload the site or its security features.
• Do not upload anything unlawful, misleading or infringing.

8. Communications consent

By creating an account you agree that we may contact you by email about your account and the properties you ask about. If you check the messaging consent box, you also agree to receive calls and text messages about off market deals at the number you provided, including messages sent with automated technology. Consent is not a condition of any purchase. Message frequency varies and we send no more than 5 messages per month. Message and data rates may apply. 9. Intellectual property

The site, its design, its copy and its photographs belong to LST Properties, LLC or to the people we license them from. You may use the site to evaluate and buy properties from us. You may not copy it for a competing service.

10. Third party links

We link to review sites, lenders, title companies and other resources for convenience. We do not control them and we are not responsible for their content or their practices.

11. Disclaimer of warranties

The site is provided on an as-is and as-available basis. To the fullest extent allowed by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non infringement. We do not warrant that the site will be uninterrupted, error free, or that every listing is current at the moment you read it.

12. Limitation of liability

To the fullest extent allowed by law, LST Properties, LLC and its members, managers, employees and agents are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost rents or lost opportunities, arising from your use of this site. Our total liability for any claim relating to the site is limited to one hundred dollars. Nothing in this section limits liability that cannot be limited under Kentucky law, and nothing here changes the terms of a signed purchase or assignment agreement.

13. Indemnification

You agree to defend and indemnify LST Properties, LLC against claims, losses and expenses, including reasonable attorney fees, arising from your use of the site, your breach of these terms, or your violation of any law or the rights of a third party.

14. Governing law and venue

These terms are governed by the laws of the Commonwealth of Kentucky, without regard to its conflict of law rules. Any dispute that is not resolved by a phone call will be brought exclusively in the state or federal courts located in Jefferson County, Kentucky, and you consent to that venue.

15. Changes

We may update these terms. The date at the top shows the current version, and continuing to use the site after a change means you accept it.
